It is possible the Department of Labor (DOL) will act by the end of this week in attempts to publish the final new overtime rule and provide the required notices to Congress by May 16.

The new rule would raise the exempt vs. non-exempt threshold from the current $23,660 annually to between $45,000 and $50,400.

When the rule is published, employers will then need to determine which positions are impacted and whether to convert each position to non-exempt, raise the salary level or restructure to accommodate the new salary requirement.
